These terms apply to the Columbus/CAN 3.5 software product.

THIS IS A LEGAL AGREEMENT TO WHICH YOU ARE CONSENTING TO BE BOUND. IF YOU DO NOT AGREE TO ALL OF THE TERMS OF THIS LICENSE, DO NOT DOWNLOAD OR USE THE SOFTWARE.

1. Software License

This is a legal agreement between you and FrontEndART Ltd. ("FrontEndART") The Columbus/CAN software tool and its documentation (the "SOFTWARE") is licensed by FrontEndART for use only on the terms set forth herein.

WARRANT. You warrant that you are a faculty member in the academic unit of the educational institution identified in the application form.

GRANT OF LICENSE. FrontEndART grants to you the right to use the SOFTWARE for non-profit academic use within your academic unit, and for no other purpose. In case of any kind of publication of results based on such academic use you should make a reference to FrontEndART\'s web page (www.frontendart.com).

TERM. This license agreement is effective upon your downloading the SOFTWARE and shall continue until terminated. The term of this agreement expires as indicated in the licence file provided to you by FrontEndART after your downloading the SOFTWARE. You may terminate this license agreement at any time by destroying or erasing all copies of the SOFTWARE in your possession, and by notifying FrontEndART, in writing, that you will not make any further use of the SOFTWARE. FrontEndART may terminate your license upon any breach by you of any term of this license agreement. Upon termination for any reason, you agree stop using the SOFTWARE, and to destroy or erase all copies of the SOFTWARE in your possession. Upon termination of this license you are no longer authorized to use the SOFTWARE thereof in any manner whatsoever. Notwithstanding the termination of this license agreement, all provisions of this license agreement relating to disclaimers of warranties, limitations of liability, remedies, damages, and FrontEndART\'s proprietary rights shall survive termination.

COPYRIGHT AND PROPRIETARY RIGHTS. The SOFTWARE is owned by FrontEndART and is protected by international laws and treaty provisions. By downloading the SOFTWARE you acknowledge the ownership rights of FrontEndART. You may make copies of the SOFTWARE solely for backup or archival purposes provided that you reproduce all copyright and other proprietary notices that are on the original copy of the SOFTWARE provided to you. Such backup copies may be used only for recovery purposes.

OTHER RESTRICTIONS. You may not rent, lease, sell, lend, license, transfer, or otherwise permit any other person other than you to use the SOFTWARE in any manner. You may not reverse engineer, decompile, disassemble, or create derivative works from the SOFTWARE.

GENERAL. This Agreement will be governed by the laws of Hungary, except that body of law dealing with conflicts of law. Should you have any questions concerning this Agreement, or if you desire to contact FrontEndART for any reason, please write to:

2. Disclaimer of warranty

To the original customer only, FrontEndART provides the following warranty.

Except as expressly specified in this agreement, the SOFTWARE and related documentation is provided by FrontEndART "as is" without warranty or condition of any kind, either express or implied, including but not limited to, merchantability, fitness for a particular purpose, or noninfringement of third parties intellectual property rights. The entire risk arising out of use, performance or distribution, as applicable, of the SOFTWARE and any documentation is with you.

SOFTWARE IS NEITHER FAULT TOLERANT NOR DESIGNED OR INTENDED FOR USE IN SECURITY-CRITICAL ACTIVITIES OR ANY ACTIVITIES WITH A HIGH RISK FOR ENVIRONMENTAL DAMAGES, PERSONAL INJURY OR DEATH OF PERSONS. NO EXPLICIT OR IMPLICIT WARRANTY OF FITNESS FOR SUCH PURPOSE AND USE IS GIVEN BY FRONTENDART.

3. Software maintenance services

FrontEndART shall have no obligation to maintain the SOFTWARE.

4. Limitation of liability

REGARDLESS OF WHETHER ANY REMEDY SET FORTH HEREIN FAILS OF ITS ESSENTIAL PURPOSE, IN NO EVENT WILL FRONTENDART BE LIABLE TO YOU FOR ANY SPECIAL, CONSEQUENTIAL, INDIRECT OR SIMILAR DAMAGES, INCLUDING ANY LOST PROFITS OR LOST DATA ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE OR ANY DATA SUPPLIED THEREWITH EVEN IF FRONTENDART OR ANYONE ELSE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY.
